Yeeps Wishlist Giveaway Official Rules

NO PURCHASE NECESSARY. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING.

The Yeeps Wishlist Giveaway (the “Sweepstakes”) will be subject to these Official Rules, and by entering, all entrants (and parents and legal guardians of entrants who are minors) agree to abide and be bound by these Official Rules and the decisions of the Sponsor.

1. Sweepstakes Period: The Sweepstakes starts at 10 AM PT on December 5, 2024 and ends at 2 PM PT on December 26, 2024 (the “Sweepstakes Period”).

2. Eligibility: The Sweepstakes is open to legal residents of the 50 United States and the District of Columbia (the “Sweepstakes Area”). Entrants must also, as of the first day of the Sweepstakes Period, be 10 years of age or older, own or have access to a Meta Quest VR headset, and have downloaded Yeeps: Hide and Seek from the Meta Quest store (the game is free to download and play). Employees (and their immediate household or family members) of Trass Games Inc. (“Sponsor”), and of any of its parent companies, affiliates, or subsidiaries, and of any advertising agencies, prize providers, promotion agencies, and/or public relations companies associated with the Sweepstakes, are not eligible to participate. Immediate family members include spouses, parents, siblings, and children. Household members include individuals living in the same residence, whether or not related. Void where prohibited and outside the Sweepstakes Area.

3. How to Enter: In order to participate, you must submit a holiday wishlist of five items you would like to receive for the holidays (the “Wishlist”). To submit the Wishlist, look for the Wishlist console within the Yeeps: Hide and Seek game. Once you access the console, you can submit your Wishlist. Click to agree to the Official Rules in order to complete and submit your entry. The Wishlist must meet the following criteria:

• The Wishlist must include no less than five items and no more than five items
• The five items on the Wishlist must total less than $10,000 in retail value;
• The items on the Wishlist must be tangible goods (for example, do not ask for travel, world peace, Bitcoin, or a new brother or sister);
• The items on the Wishlist must be available through Amazon or big box stores;
• The items on the Wishlist cannot be unique (for example, do not ask for an autographed football);
• Do not list cash or gift cards on your Wishlist;
• Do not include firearms, ammunition, or any sort of weapon on your Wishlist;
• Do not include any personalized items (i.e., items that would be customized to include your name) on your Wishlist;
• Do not include animals, food products, or pharmaceuticals (legal or illegal) on your Wishlist;
• When writing the items on your Wishlist, just list the items you want--do not state why you want them or include other narrative content;
• Be as specific as you can on your Wishlist (for example, if you would like a laptop, please provide the manufacturer, make, and model if you can);
• Include items on your Wishlist that are age-appropriate; and
• Do not include items on your Wishlist that are political or sexual in nature or that are otherwise inappropriate to be provided as a prize in a promotion offered to children and the general public.

Sponsor reserves the right, in its sole discretion, to disqualify any Wishlist and the entrant who submitted that Wishlist if Sponsor determines that the Wishlist materially deviates from the foregoing criteria. Sponsor also reserves the right, in its sole discretion, to accept Wishlists that include minor deviations from the foregoing criteria. If the entrant is under 18 years old, the entrant's parent or legal guardian must approve the Wishlist prior to submission in the Sweepstakes. The entrant may modify the Wishlist once it has been submitted, but the entrant may not modify the Wishlist after the close of the Sweepstakes Period. Each entry must be received during the Sweepstakes Period to be eligible. Limit one entry per person and per Yeeps player. Entries that exceed the limit will be void if discovered by Sponsor. Sponsor is not responsible for entries that are lost, late, deleted, garbled, damaged, misdelivered, or misdirected. Ordinary internet access and similar charges apply. All received entries become the property of Sponsor and will not be returned. If there is a dispute regarding the identity of an entrant, the holder of the email account associated with the entry will be deemed the person who submitted the entry.

4. Selection of Winners; Notification & Verification: After the close of the Sweepstakes Period, Sponsor will select the winners in a random drawing from among all eligible entries. Odds of winning depend on the number of eligible entries. The quality of entrants' Wishlists will play no role in the determination of the winners. Sponsor will make all decisions regarding all issues related to the Sweepstakes, and its decisions will be final and binding in all respects. Sponsor will attempt to contact the winners via an in-game message in Yeeps: Hide and Seek, and potential winner (or parent or legal guardian if potential winner is a minor in potential winner's' state of residence) must respond within 72 hours of the time the message is sent. The potential winner will be required to provide winner's email address to and in-game user name to Sponsor. If the potential winner is a minor in potential winner's state of residence, the potential winner will be required to have their parent or legal guardian provide the parent or legal guardian's email address and potential winner's in-game user name to Sponsor. Under no circumstances should a minor potential winner email Sponsor directly, and under no circumstances should a minor or parent or legal guardian provide a minor's email address to Sponsor. Sponsor also reserves the right to require a video call with a winner's parent or legal guardian to complete the winner verification and/or prize awarding process. Winner (and parent or legal guardian if potential winner is a minor in potential winner's' state of residence) may be required to sign an affidavit of eligibility and release and provide identification. If so, such documents must be signed and returned within seven days of the date they are sent to the winner (or parent or legal guardian if potential winner is a minor in potential winner's' state of residence). (TN residents need not sign publicity release.) Potential winner will be disqualified and an alternate winner may be selected by random drawing from among all remaining eligible entries, time permitting, if: (a) the winner (or parent or legal guardian if potential winner is a minor in potential winner's' state of residence) does not respond to the initial notification attempt within 72 hours; (b) Sponsor learns that the winner does not fulfill the eligibility requirements; (c) Sponsor learns that the winner did not adhere to these Official Rules; (d) if the winner (or parent or legal guardian if potential winner is a minor in potential winner's' state of residence) does not comply with the winner verification and prize awarding process; (e) if the Sponsor, in its sole discretion, determines the Wishlist materially deviates from the Wishlist criteria; and/or (f) the winner does not provide required identification or documents by the deadlines set by Sponsor.

5. Prizes and Delivery: There is one grand prize, and there are 100 “rare” prizes. The grand prize is the items listed on the winner's Wishlist as well as $10,000 to be applied to the winner's education and which will be awarded in the form of a check. The total approximate retail value of the grand prize is up to $20,000. Each “rare” prize is a $50 digital Meta Quest gift card. Gift card subject to terms and conditions thereon. Sponsor will send gift cards to winners (or to their parents or legal guardians) via email. The total approximate retail value of all prizes is up to $25,000.

6. Conditions Applicable to All Prizes: Sponsor is not responsible for loss, delay, or damage in delivery. Prize recipient is solely responsible for any applicable federal, state, and local taxes in connection with a prize. Prize substitutions are not allowed, and prize is not transferable or redeemable. Prize may not be redeemed for cash. All properly claimed prizes will be awarded provided a sufficient number of eligible entries are received, but in no event will more prizes than are provided for in these Official Rules be awarded. If the winner is a minor in the winner's state of residence, the prize will be awarded to the winner's parent or legal guardian on the winner's behalf.

7. Conditions Applicable to Grand Prize: If the winner is a minor in winner's state of residence, the Sponsor will consult with the winner's parent or legal guardian to determine the appropriateness of the items on a Wishlist to be awarded as part of the grand prize. In all events, Sponsor has the right to award items on the Wishlist in its discretion. For example, if the Sponsor determines that an item on the Wishlist is not an appropriate prize, it is not required to award that item, and it will not be required to award an alternate prize. If the description of the item on the Wishlist is vague (e.g., “television”), the Sponsor reserves the right to interpret the identity of the item at its sole discretion, and to award an item consistent with its interpretation. If the aggregate approximate retail value of the items on the Wishlist is less than $10,000, the Sponsor will not award the difference between the aggregate approximate retail value and $10,000. If the aggregate approximate retail value of the items on the Wishlist is more than $10,000, the Sponsor will eliminate from the Wishlist any items necessary to bring the aggregate approximate retail value below $10,000, and Sponsor will not award the difference between the new aggregate approximate retail value and $10,000. The grand prize will be delivered in January of 2025.

8. Other Conditions: By entering the Sweepstakes, each entrant (and entrant's parent or legal guardian if entrant is a minor in entrant's state of residence) agrees to release and hold harmless and waive any claims against Sponsor, Meta, and any other entity involved with the Sweepstakes, and their respective parents, affiliates, subsidiaries, advertising agencies, and promotional agencies, and all of their respective officers, directors, members, shareholders, employees, and agents from all injuries, claims, damages, losses, costs, or expenses of any kind (including without limitation attorneys' fees) resulting from submitting an entry or otherwise participating in any aspect of the Sweepstakes; the receipt, ownership, or use of the prize; preparing for, participating in, or traveling to and/or from any prize-related activity; or any printing, typographical, or other error in these Official Rules or the announcement of offering of the prizes. Neither the failure of Sponsor to insist upon or enforce strict performance of any provision of these Official Rules nor the failure, delay, or omission by Sponsor in exercising any right with respect to any term of these Official Rules will be construed as a waiver or relinquishment to any extent of Sponsor's right to assert or rely upon any such provision or right in that or any other instance. Sponsor also reserves the right, in its sole discretion, to modify these Official Rules for clarification purposes without materially affecting the terms and conditions of the Sweepstakes. If there is any discrepancy between any term of these Official Rules and the marketing or entry materials used in connection with the Sweepstakes, these Official Rules will govern.

By accepting a prize, winner (and winner's parent or legal guardian if winner is a minor in winner's state of residence) agrees, where legal, to allow Sponsor and its agents and licensees to use winner's name, voice, photograph, likeness, any statement provided by winner, and any information provided on the Wishlist, in any medium of communication, including for advertising, promotional or other purposes, without additional compensation. (TN residents need not so consent.)

9. Termination/Fraud/Tampering: If for any reason the Sweepstakes is not capable of running as planned, including public health emergency, governmental action, infection by computer virus, tampering, fraud, technical failure, or any other cause that corrupts or threatens the administration, security or integrity of the Sweepstakes, Sponsor reserves the right, in its sole discretion, to terminate or modify the Sweepstakes. If Sponsor terminates or modifies the Sweepstakes, Sponsor will post notice in the Yeeps: Hide and Seek game and Sponsor will select the winners by random drawing from among eligible, non-suspect, non-winning entries received as of the termination of the Sweepstakes, provided Sponsor is able to do so. Sponsor reserves the right to prohibit any entrant from participating in the Sweepstakes if, in its sole discretion, Sponsor finds that such entrant shows a disregard for, or attempts to circumvent, these Official Rules, or acts: (a) in a manner the Sponsor determines to be not fair or equitable; (b) in an annoying, threatening, or harassing manner; or (c) in any other disruptive manner. If a dispute arises regarding compliance with these Official Rules, Sponsor may consider, in its sole discretion, data reasonably available to Sponsor through information technology systems in Sponsor's control, but Sponsor will not be obligated to consider any data or other information collected from any other source. Sponsor assumes no liability for any unauthorized access to, or theft, destruction, or alteration of entries at any point in the operation of the Sweepstakes.

10. In Case of Dispute: By entering the Sweepstakes, entrant (and entrant's parent or legal guardian if entrant is a minor in entrant's state of residence) agrees that: (a) all disputes, claims, and causes of action arising out of or connected with the Sweepstakes, or prize awarded, will be resolved individually, without resort to any form of class action; (b) all claims, judgments, and awards will be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes but in no event attorneys' fees; and (c) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim, punitive, incidental, or consequential damages and all rights to have damages multiplied or otherwise increased and any other damages, other than for actual out-of-pocket expenses. Some jurisdictions do not allow for limitations on the ability to pursue class action remedies, or certain kinds of damages, and so these limitations may not apply to you. The Sweepstakes will be governed by and enforced pursuant to the laws of the State of California, without regard to the conflicts of laws provisions thereof. The federal and state courts located in San Francisco, California will be the exclusive forum for any dispute regarding any Official Rule or activity associated with the Sweepstakes. Each entrant (and entrant's parent or legal guardian if entrant is a minor in entrant's state of residence) agrees, by participation in the Sweepstakes, to submit to the personal jurisdiction of the federal and state courts located in San Francisco, California in connection with all disputes, claims, and causes of action arising out of or connected with the Sweepstakes, the interpretation of these Official Rules, or the prizes awarded.
